"Unforeseen mechanical failure equals wear and tear?!"

I recently as of yeterday had my mercedes put in the shop for a break issue. The caliper failed and seized. The calipers needed replacing far rear left. The failure of the caliper was not wear and tear as described by the mechanic as he explained the typical process of a caliper seizing over time and also a leak of some sort to signify a change is needed.this was a situation where the pin actually became stuck. Now i just bought this car and driven less then 3000 miles. the warranty i bought was a full car gold standard warranty covering all aspects from engine t turbo to brakes too electrical. I pay a monthly fee. Now ive been told as of today that the item is wear and tear and the repair cost is down to me. I will be seeking legal advice. I was told when i was sold this warranty that what happened to me was covered now it seems to be at there whim and personal opinion if its covered. originally it was denied before an engineer from there firm even came to look at my car..
